Legacy Hillcrest Files Suit Against UP Board

I’ll have more about this in Friday’s paper, but attorneys for Legacy Hillcrest filed a lawsuit against University Park’s Board of Adjustment Dec. 8, claiming the group illegally met in closed session.

The suit claims “no reasons were given for meeting in executive session.” Later that night, the Board reversed a staff decision, which would’ve allowed Legacy to build a parking garage on the Chase bank site.

    Thanks for the information. I know little about the BoA, are they elected or appointed? Random locals or experienced professionals? I ask because my gut reaction to the filing is that the BoA knew what the correct legal interpretation was, but colluded to vote unanimously the other way in order to provide themselves with political cover against a vocal minority. This despite the lawsuit that would assuredly come and the cost to the good people of UP to defend against it.

    I’d be surprised if that was the case – in this city even the threat of a wholly meritless (no pun intended)lawsuit is enough to get the city to roll over.

    The Blockbuster on Hillcrest at University is closing. An employee told us Chase Bank is moving in. I’m happy for Chase, but I hate losing the video store. The closest one will be on Lovers and Greenville.
